What Businesses Does the Employee Free Choice Act Affect?
- Any business in any sector (service, banking, construction, food service, etc.) with more than one employee.
What is Proposed Under EFCA?
- Based on the proposed Employee Free Choice Act, if a majority of a company’s employees sign a card pledging support for the union then the National Labor Relations Board will certify the union as the representative of your workers without a secret-ballot election. In addition, EFCA includes tougher penalties for employers who violate provisions of the National Labor Relations Act when employees are attempting to form a union and set in place new mediation and arbitration procedures.
